1. Who we are

This site is operated by FutGen Holdings LLC, a company incorporated in the State of Wyoming, United States, with registered address at 30 N Gould St, Sheridan, WY 82801. FutGen Strategic Consulting is the trade name of one of its divisions. In these terms, "we" refers to FutGen Holdings LLC.

2. What this site is and is not

This site presents our consulting services and the platform we implement. Its content is informational and general in nature.

Nothing published here constitutes a binding offer, a contractual proposal, a quotation, or a guarantee of results. The scope, pricing, timelines and conditions of any service are defined solely in a written proposal and contract signed by the parties. If this site and that contract conflict, the contract prevails.

Descriptions of modules and features relate to a third party's platform and may change without our control. The specific configuration for each organization is defined during implementation.

3. Use of the site

You may browse this site, read it, print it and share it within your organization for evaluation purposes. By using it, you undertake not to:

• Use it for unlawful purposes or contrary to these terms.
• Attempt unauthorised access to systems, servers or restricted areas.
• Introduce malicious software or take any action affecting its operation, availability or security.
• Extract content in an automated and systematic manner for commercial reuse.
• Impersonate FutGen or suggest a relationship, endorsement or representation that does not exist.

We may restrict access for anyone who breaches these terms.

4. Our intellectual property

Except as set out in section 5, the text, design, structure, code and trademarks on this site — including "FutGen", "FutGen Strategic Consulting", "We build belonging" / "Construimos pertenencia" and the three circles of belonging framework — are owned by FutGen Holdings LLC or used with authorisation, and are protected by applicable intellectual property law.

Using the site transfers no rights in them to you. Any use beyond that set out in section 3 requires our prior written authorisation.

5. Third-party trademarks

This site mentions third-party names and trademarks — among them Humand, and organizations such as Swiss Medical, Medicus, Centro Médico ABC, ArcelorMittal Acindar, John Deere, Siemens, River Plate, Farmacity, OXXO, Domino's and Día. We expressly record the following:

• All such trademarks and trade names belong to their respective owners. FutGen claims no rights in them.
• They are mentioned for informational and descriptive purposes only, to give context on the reach of the platform we implement.
• Where we state that an organization uses the Humand platform, we refer to information published by Humand or reported in the press.
• Those organizations are not clients of FutGen. Mentioning them does not imply that they are our clients or that they have any commercial relationship with us.
• Mentioning them implies no sponsorship, endorsement, recommendation, affiliation or connection whatsoever between those organizations and FutGen.

If you own any of these trademarks and consider their mention here inappropriate, write to start@futgenconsulting.com and we will review it immediately.

6. Our relationship with Humand

FutGen Strategic Consulting is a partner of Humand Technologies, Inc. We are two independent companies: we are not the same company, neither is a subsidiary of the other, and neither acts as the other's legal representative.

The platform is owned by Humand and is governed by its own terms and policies. FutGen provides the consulting: diagnosis, implementation design, adoption support and measurement. Any obligation of Humand in respect of the platform — licence, support, availability, hosting — rests with Humand and is agreed with Humand.

Platform figures and data we cite come from Humand's public communications and may change over time. We make reasonable efforts to keep them current, but we do not warrant their permanent accuracy.

7. No professional advice

The content of this site does not constitute legal, tax, accounting, employment or medical advice, and should not be used as a substitute for consulting a qualified professional in your jurisdiction. Decisions you take based on this information are your responsibility.

8. Third-party links and content

The site may contain links to third-party sites. We do not control their content or policies and we are not responsible for them. Including a link does not imply that we endorse that site or its content.

9. Site availability

We aim to keep the site available and up to date, but we do not guarantee uninterrupted availability or freedom from errors. We may modify, suspend or discontinue the site or any of its sections at any time and without prior notice.

10. Limitation of liability

To the maximum extent permitted by applicable law, the site and its content are provided "as is", without warranties of any kind, express or implied, including those of accuracy, merchantability or fitness for a particular purpose.

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, consequential or special damages, or for loss of profits, arising from access to or use of the site, or from the inability to access it.

Nothing in this section limits our liability for wilful misconduct, gross negligence, or any case in which applicable law does not permit limitation.

11. Governing law and jurisdiction

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute arising from the use of this site shall be submitted to the competent courts of Sheridan County, State of Wyoming.

If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your home courts or to the application of its mandatory protective rules, this clause does not affect that right.

If a competent court declares any provision of these terms invalid or unenforceable, the remainder shall continue in full force.

12. Changes and contact

We may update these terms. When we do, we change the "last updated" date in the header, and the version in force is always the one published on this page. We recommend reviewing it from time to time.
